The 2026 Hemp Ban, Explained.

How we got here

In 2018, Congress passed the Farm Bill, which made hemp legal. The law defined hemp as cannabis with less than 0.3% delta-9 THC by dry weight.

This limit allows companies to make hemp-derived products like gummies, body care, tinctures, and more to be full-spectrum (meaning they contain a whole suite of cannabinoids, including less than 0.3% delta-9 THC). With that came many unregulated products being sold in gas stations, grocery stores, and many other places with little oversight.

Keep Relief Within Reach – Body Care

In November 2025, Congress changed the rules as part of the bill that ended the government shutdown. Supporters said the goal was to close that loophole and put safeguards around hemp products.

What the new law says

The old rule measured THC as a percentage of the plant. The new rule counts the milligrams of THC in the whole package.

For example, our Boujee Bear Gummies have 25mg of full-spectrum CBD, with a trace amount of THC to help with the entourage effect. This new definition of hemp would ban these and everything else we currently carry that is full-spectrum. The new 0.4mg per container rule would mean you would have to eat BAGS and BAGS of Boujee Bears to simply feel the same effect as one of our current gummies.

What it could mean for our products

The new rules are scheduled to take effect on December 11, 2026. The original effective date was November 12, and Congress has already extended it once, so it could change again. If Congress does not act before then, products like ours will no longer qualify as legal hemp.

Why this matters to us

Don't get us wrong, we believe in regulation, but this is going to basically mean prohibition, as 95% of the hemp market (like us, who do it the right way) will become obsolete. This isn't just a policy change, because a ban this broad doesn't only remove bad products. This would annihilate all of our current products as we know it. The products that change lives.

What happens next?

Honestly, nobody knows. Congress has two main paths:

  • Path 1: The new rules take effect as written. THC would be all but eliminated from hemp products, including the natural traces in full-spectrum CBD. Products like ours could no longer be sold as hemp.
  • Path 2: Congress updates the rules. Like clear age limits, required lab testing, labels, etc. We already do all of these. That's the version we're rooting for.
